Terms of service

These terms govern your use of Nosie (nosie.app), a service operated by Ortomate Ltd., 12 Jessie Street, Wellington, New Zealand. By creating an account you agree to them. Questions? Email hello@nosie.app.
1. The service
Nosie runs brief, consent-based micro-interviews with contacts you provide, by phone, SMS, email, and hosted web pages, and returns structured results to you. We may improve or change features over time.
2. Your responsibilities — consent above all
You must have a lawful basis and recorded consent for every contact you ask Nosie to reach, and you attest to this each time you add a contact. You must not upload contacts who have not agreed to be contacted, and you must comply with the laws that apply to your contacts' locations (including New Zealand's Privacy Act 2020 and any Australian or United States telemarketing and consent rules). Opt-outs are final: once a contact opts out, neither you nor we may contact them through Nosie again.
3. Fair use and prohibited conduct
No harassment, deception, or unsolicited marketing. No attempting to identify or contact people outside the purpose stated in your project brief. No reselling of interview capacity without our written agreement. We may suspend accounts that put contacts, other customers, or the service at risk.
4. Billing
The Nosie Standard plan is NZD $20 per month including 10 completed interviews, then NZD $2 per additional completed interview, billed monthly in arrears through Stripe. Only completed interviews are billable. Included interviews reset each period and do not roll over. If payment fails we may pause outreach and, after repeated failures, suspend the account.
5. Your data
You own your project briefs and interview results. Interview data is retained for 90 days and then purged automatically — export anything you need before then. Our Privacy policy explains how we handle personal information.
6. Liability
Nosie is provided on an "as is" basis. To the maximum extent permitted by law, Ortomate Ltd.'s total liability under these terms is limited to the fees you paid in the three months before the event giving rise to the claim. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 where it applies.
7. Governing law
These terms are governed by New Zealand law and any dispute will be handled by the courts of Wellington, New Zealand.
